KuronekoServer API Service Terms of Service
These Terms of Service (hereinafter referred to as “the Terms”) set forth the conditions for using the API service (hereinafter referred to as “the Service”) provided by the KuronekoServer Operations Team (hereinafter referred to as “the Operations Team”).
Users of the Service (hereinafter referred to as “Users”) shall use the Service in accordance with the Terms.
Article 1 (Applicability of the Terms)
- The Terms apply to all relationships between Users and the Operations Team regarding the use of the Service.
- The Operations Team may establish additional terms of use (hereinafter referred to as “Individual Provisions”) in addition to the Terms. Regardless of their name, such Individual Provisions shall constitute part of the Terms.
- If there is any discrepancy between the Individual Provisions and the Terms, the Individual Provisions shall prevail unless otherwise specified.
Article 2 (Prohibited Conduct)
Users must not engage in any of the following acts when using the Service:
- Acts that interfere with, or attempt to interfere with, the operation of the Service, KuronekoServer (hereinafter referred to as “the Organization”), or services provided by third parties, via the facilities of the Service.
- Acts that may result in the global IP address allocated for IP communications being registered on blacklists, or acts that may harm the Organization’s reputation or credit, or acts that may lead to such outcomes.
- Acts that impose unnecessary load (whether intentional or negligent) on the Organization’s facilities (network/server facilities, etc.), thereby impairing service quality or the ability of upstream providers to provide their services.
- Acts that intentionally use the Service in a manner intended to satisfy the requirements for disclosure requests under the Provider Liability Limitation Act, or acts that may lead to such use.
- Acts that exhaust resources due to unauthorized traffic (communications) from external or internal sources, thereby obstructing normal traffic of Users, etc.
- Acts that tamper with information used in IP network services, or acts that may do so.
- Unauthorized access to the Service, attempts thereof, or transmitting information that contains harmful computer programs.
- Violations of laws and regulations in Japan, or acts that encourage illegal conduct.
- Posting or sending information that is extremely offensive to others under common social norms, such as information about murder scenes, cruel content, images of animal abuse, etc.
- Acts that involve any interaction or involvement with anti-social forces (such as organized crime groups, members of such groups, right-wing groups, anti-social forces, or any equivalent), including cooperating with or participating in their maintenance, operation, or management.
- Reselling the Service without prior permission from the Organization.
- Engaging in cryptocurrency mining, data mining, or similar activities.
- Fraudulently using, transferring, or lending IP addresses, accounts (including login IDs), passwords, email addresses, or domains.
- Illegally using or abusing bugs, defects, vulnerabilities, etc. against the Organization.
- Acts that directly or indirectly cause, facilitate, or encourage any act falling under any of the preceding items, or acts that may do so.
- Posting links to sites that fall under, or may fall under, any of the preceding items.
- Violations of the terms of service and/or guidelines of service providers.
- Impersonating other Users, the Operations Team, or KuronekoServer.
- Acts that cause disadvantage or damage to the Service, the Operations Team, or Users.
- Submitting requests exceeding 100 characters, which is the maximum number of characters that can be processed by the voice synthesis API.
- Connecting using Tor.
- Any other acts deemed inappropriate by the Operations Team.
Article 3 (Restrictions, etc.)
If the Organization discovers a User who violates the Terms, the Organization will prohibit the provision of the Service to that User. The Organization and the Operations Team shall not be liable for any disadvantage arising therefrom.
- If communications increase excessively, the Organization may restrict communications or block access.
- For each API provided by the Organization, if access from the same IP address exceeds 50 requests per second, temporary restrictions, blocking, or equivalent measures may be applied through access control.
Article 4 (Invalidation)
If it is discovered that any of the following applies, the Organization may suspend use and invalidate the right to use the Service, etc., without prior notice.
- When the Operations Team determines that the User has not read the Terms.
- When the User attempts to affect the operation of the Service through illegal acts.
- When the Operations Team determines that the User has been forcibly terminated from other services provided by the Organization.
- When the Operations Team determines that the User violates the Terms, etc.
- Any other case where the Operations Team determines that granting the right to use the Service, etc. is inappropriate.
Article 5 (Preservation of Communication Logs)
In the following cases, the Organization shall not be obligated to dispose of log information that includes sender information, in order to protect the secrecy of communications.
- When a court, etc. issues an order to preserve logs (including an order prohibiting deletion of sender information) to the Organization.
- When a request to preserve logs is made to the Organization and the communication logs submitted by the requester match the information of the Organization’s facilities.
- When any other legally binding disposition is carried out pursuant to laws and regulations.
Article 6 (Commencement of Use and Usage Restrictions)
- These Terms apply at the time the User makes a request to the Service’s API.
- The Operations Team may restrict part or all of the Service in any of the following cases.
- When the User violates these Terms and/or Individual Provisions.
- When the User violates the terms of service and/or guidelines of the service provider.
- Any other case where the Operations Team deems it inappropriate.
Article 7 (Termination or Suspension of the Service)
The Service may be terminated or temporarily suspended for any of the following reasons.
- When performing maintenance, inspection, or repair of equipment necessary to provide the Service.
- When performing maintenance work on server equipment.
- When updating programs.
- When server equipment or programs stop due to accidents, crashes, etc.
- When continuation of operation becomes difficult due to unforeseen events such as earthquakes, lightning, or heavy rain.
- Any other case where the Operations Team determines that it is difficult to continue operating the Service.
Article 8 (Changes to the Service)
The Operations Team may change the Service or suspend the Service without notifying the User.
The Operations Team shall not be liable for any disadvantage or damage incurred by the User or any third party due to termination or suspension of the Service.

Article 10 (Disclaimer of Warranties and Limitation of Liability)
- The Operations Team makes no express or implied warranties that the Service is free from defects in fact or law (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, infringement of rights, etc.).
- The Operations Team shall not be liable for any disadvantage arising for the User due to the Service.
- The Operations Team shall not be liable for any disputes or transactions between Users or between the User and any third party in connection with the Service.
Article 11 (Changes to the Terms)
- The Operations Team may change these Terms and Individual Provisions without prior notice to the User.
- If the User continues to use the Service after receiving a notice of changes from the Operations Team, the User shall be deemed to have agreed to the new terms.
Article 12 (Handling of Data)
The Operations Team shall manage data obtained through use of the Service in accordance with the “KuronekoServer API Service Privacy Policy”.
However, this shall not apply where compulsory measures based on Article 218 of the Code of Criminal Procedure (search by warrant) are carried out, or where the requirements for disclosure requests under the Provider Liability Limitation Act are satisfied.
Article 13 (Governing Law and Jurisdiction)
- These Terms shall be governed by and construed in accordance with the laws of Japan.
- Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the Saga District Court.
Article 14 (Additional Conditions for the OpenJTalk API)
- This Article applies only to the OpenJTalk API service provided by KuronekoServer and to the use of audio generated through that service, and does not apply to other KuronekoServer services. However, this does not apply where separate provisions are established for such other services.
- Among the acoustic models available through the OpenJTalk API, the models 20saidannsei, akesato, amatukiriyonn, amenewamea, asobunehitori, enndouai, gigarannka, giruko, gurimarukin, hakukomai, keikakaoru, kemononerou, kuonnkono, kuutakanata, makimiyafuuki, makotokoto, matuop, momonemomo, nanaironizi, notaminesou, omoineikuru, omoineikuto, runarami, satohomu, soukanero, surannki, syouziyoe, waonnsiba, watasi, yamiyosakura, and zuigamizuki may be used free of charge within the scope of non-commercial activities common to the respective speaker-specific terms, including non-profit doujin activities. When publishing works created using those acoustic models, no prior or subsequent notice to the copyright holder or distributor is required. However, download sales are not included in the scope of non-commercial use, and commercial use or use beyond the above scope requires separate permission.
