KuronekoServer Artifacter Terms of Service

These Terms of Service (hereinafter referred to as “the Terms”) set forth the conditions for using Artifacter (hereinafter referred to as “the Service”) provided by the KuronekoServer Operations Team (hereinafter referred to as “the Operations Team”).

Users of the Service (hereinafter referred to as “Users”) shall use the Service in accordance with the Terms.

Article 1 (Applicability of the Terms)

  1. The Terms apply to all relationships between Users and the Operations Team regarding the use of the Service.
  2. The Operations Team may establish additional terms of use (hereinafter referred to as “Individual Provisions”) in addition to the Terms. Regardless of their name, such Individual Provisions shall constitute part of the Terms.
  3. If there is any discrepancy between the Individual Provisions and the Terms, the Individual Provisions shall prevail unless otherwise specified.
  4. If the terms of service, etc. of service providers such as Discord (hereinafter referred to as “Providers”) conflict with the Terms, the Providers’ terms shall prevail.

Article 2 (Prohibited Conduct)

Users must not engage in any of the following acts when using the Service:

  1. Acts that interfere with, or attempt to interfere with, the operation of the Service, KuronekoServer (hereinafter referred to as “the Organization”), or services provided by third parties, via the facilities of the Service.
  2. Acts that impose unnecessary load (whether intentional or negligent) on the Organization’s facilities (network/server facilities, etc.), thereby impairing service quality or the ability of upstream providers to provide their services.
  3. Acts that intentionally use the Service in a manner intended to satisfy the requirements for disclosure requests under the Provider Liability Limitation Act, or acts that may lead to such use.
  4. Acts that exhaust resources due to unauthorized traffic (communications) from external or internal sources, thereby obstructing normal traffic of Users, etc.
  5. Acts that tamper with information used in IP network services, or acts that may do so.
  6. Unauthorized access to the Service, attempts thereof, or transmitting information that contains harmful computer programs.
  7. Violations of laws and regulations in Japan, or acts that encourage illegal conduct.
  8. Acts that involve any interaction or involvement with anti-social forces (such as organized crime groups, members of such groups, right-wing groups, anti-social forces, or any equivalent), including cooperating with or participating in their maintenance, operation, or management.
  9. Illegally using or abusing bugs, defects, vulnerabilities, etc. against the Organization.
  10. Acts that directly or indirectly cause, facilitate, or encourage any act falling under any of the preceding items, or acts that may do so.
  11. Violations of the terms of service and/or guidelines of Providers.
  12. Impersonating other Users, the Operations Team, or KuronekoServer.
  13. Acts that cause disadvantage or damage to the Service, the Operations Team, or Users.
  14. Using the Service for commercial purposes or for profit.
  15. Editing, altering, or processing generated images or their image data (including metadata changes or changes made by programs, etc.).
  16. Any other acts deemed inappropriate by the Operations Team.

Article 3 (Restrictions, etc.)

If the Organization discovers a User who violates the Terms, the Organization will prohibit the provision of the Service to that User. The Organization and the Operations Team shall not be liable for any disadvantage arising therefrom.

Article 4 (Invalidation)

If it is discovered that any of the following applies, the Organization may suspend use and invalidate the right to use the Service, etc., without prior notice.

  1. When the Operations Team determines that the User has not read the Terms.
  2. When the User attempts to affect the operation of the Service through illegal acts.
  3. When the Operations Team determines that the User has been forcibly terminated from other services provided by the Organization.
  4. When the Operations Team determines that the User violates the Terms, etc.
  5. Any other case where the Operations Team determines that granting the right to use the Service, etc. is inappropriate.

Article 5 (Preservation of Communication Logs)

In the following cases, the Organization shall not be obligated to dispose of log information that includes sender information, in order to protect the secrecy of communications.

  1. When a court, etc. issues an order to preserve logs (including an order prohibiting deletion of sender information) to the Organization.
  2. When a request to preserve logs is made to the Organization and the communication logs submitted by the requester match the information of the Organization’s facilities.
  3. When any other legally binding disposition is carried out pursuant to laws and regulations.

Article 6 (Commencement of Use and Usage Restrictions)

  1. The Terms apply when a server administrator installs the bot, when a User belongs to a server where the Service is used, or when the User uses the Service.
  2. The Operations Team may restrict part or all of the Service in any of the following cases.
  3. When the User violates the Terms and/or Individual Provisions.
  4. When the User violates the terms of service and/or guidelines of Providers.
  5. Any other case where the Operations Team deems it inappropriate.

Article 7 (Termination or Suspension of the Service)

The Service may be terminated or temporarily suspended for any of the following reasons:

  1. When performing maintenance, inspection, or repair of equipment necessary to provide the Service.
  2. When performing maintenance work on server equipment.
  3. When updating programs.
  4. When server equipment or programs stop due to accidents, crashes, etc.
  5. When continuation of operation becomes difficult due to unforeseen events such as earthquakes, lightning, or heavy rain.
  6. Any other case where the Operations Team determines that it is difficult to continue operating the Service.

Article 8 (Changes to the Service)

The Operations Team may change or suspend the Service without notifying the User. The Operations Team shall not be liable for any disadvantage or damage suffered by the User or any third party due to termination or suspension of the Service.

Article 9 (Reporting Contact)

Article 10 (Disclaimer)

  1. The Operations Team does not expressly or impliedly warrant that the Service is free from defects in fact or law (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, infringement, etc.).
  2. The Operations Team shall not be liable for any disadvantage suffered by the User arising from the Service.
  3. The Operations Team shall not be responsible for any disputes or transactions arising between Users or between a User and a third party in connection with the Service.

Article 11 (Changes to the Terms)

  1. The Operations Team may change the Terms and Individual Provisions without prior notice to the User.
  2. If the User continues to use the Service after receiving notice of changes from the Operations Team, the User shall be deemed to have agreed to the revised Terms.

Article 12 (Handling of Data)

The Operations Team shall manage data obtained in connection with use of the Service in accordance with the “KuronekoServer Artifacter Privacy Policy”.
