KuronekoServer CDN Server Terms of Service

These KuronekoServer CDN Server Terms of Service (the “Terms”) set forth the conditions for using all CDN Server services (the “Service”) provided by the KuronekoServer operations team (the “Operations Team”).

Any person who uses the Service (the “User”) must use it in accordance with these Terms.

Article 1 (Applicability)

  1. These Terms apply to all relationships between the User and the Operations Team relating to the use of the Service.
  2. In addition to these Terms, the Operations Team may establish separate rules, guidelines, or other terms of use (collectively, the “Individual Provisions”). Regardless of their name, such Individual Provisions constitute part of these Terms.
  3. If there is any discrepancy between the Individual Provisions and these Terms, the Individual Provisions shall prevail unless otherwise specified.
  4. Copyrights in all data and other content belong to their respective authors. If the terms of those authors conflict with these Terms, the authors’ terms shall prevail.

Article 2 (Prohibited Conduct)

In using the Service, the User must not engage in any of the following:

  1. Acts that interfere with, or attempt to interfere with, the operation of the Service, KuronekoServer (the “Organization”), or services provided by third parties, via the facilities of the Service.
  2. Acts that cause, or may cause, the global IP address assigned for IP communications under the Service to be listed on blacklists, or that degrade the Organization’s reputation or creditworthiness.
  3. Acts that impose unnecessary load (whether intentional or negligent) on the Organization’s facilities (network/server facilities, etc.), thereby impairing service quality or the ability of upstream providers to provide their services.
  4. Acts that intentionally use the Service in a manner intended to satisfy the requirements for disclosure requests under the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Sender Information (the “Provider Liability Limitation Act”), or acts that may lead to such use.
  5. Acts that exhaust resources due to unauthorized traffic (communications) from external or internal sources, thereby obstructing normal traffic of Users, etc.
  6. Acts that tamper with information used in IP network services, or acts that may do so.
  7. Unauthorized access to the Service, attempts thereof, or transmitting information that contains harmful computer programs.
  8. Violations of laws and regulations in Japan, or acts that encourage illegal conduct.
  9. Posting or sending to an unspecified number of persons cruel information such as murder scenes, information such as images of animal abuse, or other information that may cause significant discomfort to others under social norms.
  10. Acts that involve any interaction or involvement with anti-social forces (organized crime groups, members thereof, right-wing groups, anti-social forces, or similar; the same applies hereinafter), including cooperating with or participating in their maintenance, operation, or management.
  11. Reselling the Service without prior permission from the Organization.
  12. Illegal use or abuse of bugs, defects, vulnerabilities, etc. against the Organization.
  13. Acts that directly or indirectly cause, facilitate, or encourage any act falling under any of the preceding items, or acts that may do so.
  14. Posting links to sites that fall under any of the preceding items, or that may do so.
  15. Violations of the terms of service and/or guidelines of the service provider.
  16. Impersonating other Users, the Operations Team, or KuronekoServer.
  17. Acts that cause disadvantage or damage to the Service, the Operations Team, or Users.
  18. Connecting using Tor.
  19. Using the Partner API to delete, modify, or otherwise interfere with directories managed by other Users.
  20. Any other acts deemed inappropriate by the Operations Team.

Article 3 (Restrictions)

If the Organization discovers a User who violates these Terms, the Organization will prohibit the provision of the Service to that User.

The Organization and the Operations Team shall not be liable for any disadvantage arising therefrom.

  1. If communications increase excessively, the Organization may restrict communications and/or block access.
  2. If the User uses the API to interfere with, access, delete, or modify directories other than those permitted without authorization, the Organization will immediately suspend/restrict use.

Article 4 (Invalidation)

If it is discovered that any of the following applies, the Organization may suspend use and invalidate the right to use the Service, etc., without prior notice.

  1. When the Operations Team determines that the User has not read these Terms.
  2. When the User attempts to affect the operation of the Service through illegal acts.
  3. When the Operations Team determines that the User has been forcibly terminated from other services provided by the Organization.
  4. When the Operations Team determines that the User violates these Terms, etc.
  5. Any other case where the Operations Team determines that granting the right to use the Service, etc. is inappropriate.

Article 5 (Preservation of Communication Logs)

In the following cases, the Organization shall not be obligated to dispose of log information that includes sender information, in order to protect the secrecy of communications.

  1. When a court, etc. issues an order to preserve logs (including an order prohibiting deletion of sender information) to the Organization.
  2. When a request to preserve logs is made to the Organization and the communication logs submitted by the requester match the information of the Organization’s facilities.
  3. When any other legally binding disposition is carried out pursuant to laws and regulations.

Article 6 (Commencement of Use and Usage Restrictions)

  1. These Terms apply at the time the User accesses the Service website.
  2. The Operations Team may restrict part or all of the Service in any of the following cases.
  3. When the User violates these Terms and/or Individual Provisions.
  4. When the User violates the terms of service and/or guidelines of the service provider.
  5. Any other case where the Operations Team deems it inappropriate.

Article 7 (Termination or Suspension of the Service)

The Service may be terminated or temporarily suspended for any of the following reasons.

  1. When performing maintenance, inspection, or repair of equipment necessary to provide the Service.
  2. When performing maintenance work on server equipment.
  3. When updating programs.
  4. When server equipment or programs stop due to accidents, crashes, etc.
  5. When continuation of operation becomes difficult due to unforeseen events such as earthquakes, lightning, or heavy rain.
  6. Any other case where the Operations Team determines that it is difficult to continue operating the Service.

Article 8 (Changes to the Service)

The Operations Team may change the Service or suspend the Service without notifying the User.

The Operations Team shall not be liable for any disadvantage or damage incurred by the User or any third party due to termination or suspension of the Service.

Article 10 (Disclaimer of Warranties and Limitation of Liability)

  1. The Operations Team makes no express or implied warranties that the Service is free from defects in fact or law (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, infringement of rights, etc.).
  2. The Operations Team shall not be liable for any disadvantage arising for the User due to the Service.
  3. The Operations Team shall not be liable for any disputes or transactions between Users or between the User and any third party in connection with the Service.

Article 11 (Changes to the Terms)

  1. The Operations Team may change these Terms and Individual Provisions without prior notice to the User.
  2. If the User continues to use the Service after receiving a notice of changes from the Operations Team, the User shall be deemed to have agreed to the new terms.

Article 12 (Handling of Data)

The Operations Team shall manage data obtained through use of the Service in accordance with the “KuronekoServer CDN Server Privacy Policy”.

However, this shall not apply where compulsory measures based on Article 218 of the Code of Criminal Procedure (search by warrant) are carried out, or where the requirements for disclosure requests under the Provider Liability Limitation Act are satisfied.

Article 13 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the Saga District Court.
