Nekorelay Terms of Service

These Nekorelay Terms of Service (the “Terms”) set out the terms and conditions for using the Minecraft Java Edition relay service, “Nekorelay” (the “Service”), provided by KuronekoServer (the “Organization”).

The Service is not an official service provided, endorsed, sponsored, or operated by Mojang Studios or Microsoft. The Minecraft name and other rights belong to their respective rightsholders.

Article 1 (Scope)

  1. These Terms apply between the Organization and every person who uses the Service, including persons who publish a Minecraft server using the Service and persons who connect to such a server through the Service (collectively, “Users”).
  2. Notices, guidelines, and other individual conditions established by the Organization through the official website, distribution pages, documentation, or other means (the “Individual Provisions”) form part of these Terms.
  3. If these Terms conflict with the Individual Provisions, the Individual Provisions prevail unless they expressly provide otherwise.

Article 2 (Acceptance of the Terms)

  1. Users shall use the Service only after agreeing to these Terms and the Nekorelay Privacy Policy.
  2. A User is deemed to have agreed to these Terms when that User begins using the Service.

Article 3 (The Service)

  1. The Service relays communications between Minecraft servers managed by Users and relay servers managed by the Organization, making those Minecraft servers accessible from outside.
  2. The Service’s relay servers, API, authentication infrastructure, website, and other facilities used to provide the Service are operated on servers managed by the Organization.
  3. The features, methods of use, usage limits, supported environments, and other conditions for the Service are as stated on the official website, distribution pages, or displays within the Service.
  4. Hostnames, IP addresses, and port numbers assigned through the Service may be changed or reclaimed because of reconnection, usage status, failures, maintenance, or other circumstances.
  5. The Organization does not guarantee the content, quality, safety, or continuity of Minecraft servers published using the Service.

Article 4 (Accounts and Authentication Information)

  1. Where account features are provided, Users shall keep their registration information accurate and up to date.
  2. Users shall manage passwords, sessions, tokens, and other authentication information at their own responsibility and shall not allow third parties to use them.
  3. If leakage or unauthorized use of authentication information becomes known, the User shall promptly take necessary measures and contact the Organization.
  4. The Organization is not liable for damage resulting from inadequate management of authentication information by a User or its use by a third party, except where the damage is attributable to the Organization.

Article 5 (User Responsibilities)

  1. Users shall prepare, at their own responsibility and expense, the authority, equipment, software, and communication environment necessary to use the Service.
  2. Users who publish a Minecraft server shall have the authority necessary to publish that server and shall take necessary security measures, including authentication, access control, backups, and updates.
  3. Users shall comply with applicable laws, these Terms, the Minecraft EULA, the Minecraft Usage Guidelines, and the terms of any third-party services they use.
  4. Users who publish a Minecraft server shall appropriately handle, at their own responsibility, player information, chats, game data, logs, and other information obtained or stored on that server.
  5. When using a feature that forwards a connecting party’s IP address or similar information to a Minecraft server, the User shall determine whether it is necessary and provide notices to players and take other necessary measures.
  6. The Organization is not the administrator of Minecraft servers published by Users and is not responsible for their content, operation, billing, user support, stored data, or security.

Article 6 (Prohibited Acts)

Users shall not engage in any of the following acts when using the Service.

  1. Acts that violate applicable laws, public order and morals, these Terms, or the Individual Provisions.
  2. Using the Service for purposes other than publishing a Minecraft server.
  3. Unauthorized access, attacks, exploitation of vulnerabilities, transmission of malware, or any other act that harms the facilities, services, or information of the Organization or a third party.
  4. Circumventing limits on the number of connections, bandwidth, ports, accounts, tokens, or other usage restrictions.
  5. Causing unnecessary load on the Service or a third party’s facilities through excessive communications, a large number of connections, or similar acts.
  6. Interfering with the operation of services of the Organization or a third party.
  7. Using another person’s server, account, authentication information, public address, or other information without authorization.
  8. Infringing the copyrights, trademark rights, privacy, or other rights of the Organization or a third party.
  9. Fraud, threats, harassment, discrimination, provision of illegal content, or any other act that causes disadvantage or damage to a third party.
  10. Selling, subleasing, or providing to a third party any right to use the Service, account, token, bandwidth, or public address without the Organization’s prior consent.
  11. Misusing information obtained from defects, vulnerabilities, or configuration errors.
  12. Making false or misleading representations about a relationship with the Organization or a third party.
  13. Any act comparable to the preceding items or any other act that the Organization reasonably determines to be inappropriate for providing the Service.

Article 7 (Usage Restrictions)

  1. If a User violates these Terms, the Organization reasonably determines that a violation may occur, or restrictions are necessary to ensure the safety of the Service and its users, the Organization may, without prior notice, refuse connections, change usage limits, reclaim public addresses, invalidate authentication information, suspend accounts, or take other necessary measures.
  2. To comply with laws or lawful requests from rightsholders, the Organization may restrict use of the Service, preserve information, or cooperate with relevant authorities to the necessary extent.
  3. The Organization is not liable for damage suffered by a User as a result of the measures in the preceding two paragraphs, except where the damage is attributable to the Organization.

Article 8 (Handling of Communications and Information)

  1. The Organization processes information concerning communications and connections to the extent necessary to provide the Service, ensure safety, respond to failures, prevent misuse, and comply with laws.
  2. The Service relays communications with Minecraft servers in real time and does not provide a function that permanently stores communication contents.
  3. The handling of information in the Service is set out in the Nekorelay Privacy Policy.

Article 9 (External Services)

  1. The Service may use services provided by third parties for provision, distribution, notification, authentication, or similar purposes.
  2. Use of external services is governed by the terms of service and privacy policies of those services.
  3. The Organization cannot control the suspension, failures, specification changes, usage restrictions, or handling of information by external services, and is not liable for them except where the matter is attributable to the Organization.

Article 10 (Intellectual Property Rights)

  1. Rights in software, names, logos, websites, documentation, and other content related to the Service belong to the Organization or the legitimate rightsholder.
  2. Nekorelay’s source code is not publicly available. The Organization grants Users a non-exclusive, non-transferable right to use the software distributed by the Organization solely to the extent necessary to use the Service in accordance with these Terms.
  3. Except where permitted by law or by the Organization’s prior written permission, Users shall not copy, modify, redistribute, sell, publicly transmit, reverse engineer, decompile, or disassemble software or content provided by the Organization.

Article 11 (Changes, Suspension, and Termination of the Service)

  1. The Organization may change, suspend, or terminate all or part of the Service due to maintenance, failures, security needs, changes to facilities or external services, usage conditions, legal requests, or other circumstances.
  2. For planned downtime or material changes, the Organization will provide notice in advance on the official website or by another appropriate means to the extent reasonably possible. This does not apply in an emergency.
  3. For this Service, which is provided free of charge, the Organization does not guarantee any service period, continuity, availability, or future provision.

Article 12 (Disclaimer of Warranties and Limitation of Liability)

  1. The Organization does not guarantee that the Service will always be available, be free of failures, avoid delayed or interrupted communications, be safe, complete, accurate, fit for a particular purpose, or compatible with third-party software.
  2. Users understand that use of the Service makes their Minecraft servers accessible from the Internet and that they may be connected to, attacked, or discovered by third parties. Users shall use the Service at their own responsibility.
  3. If the Service cannot be used because of a server outage, facility or network failure, maintenance, suspension of an external service, delayed or interrupted communications, a change or reclamation of a public address, or any other reason, the Organization will generally not compensate for resulting damage.
  4. If damage is caused to a User through a reason attributable to the Organization and the Organization is legally liable, its liability is limited to actual, direct, and ordinary damage. This limitation does not apply to intentional misconduct or gross negligence by the Organization or where liability cannot be limited by law.
  5. Except where legally liable, the Organization is not liable for loss or corruption of data, recovery costs, loss of players, reputational harm, lost profits, loss of business opportunities, indirect damage, or special damage.

Article 13 (Disputes with Third Parties)

  1. If a dispute arises between a User and a third party in connection with the Service or a Minecraft server published by the User, the User shall resolve it at their own responsibility and expense.
  2. If damage or expense is incurred by the Organization for a reason attributable to a User, the User shall bear that damage and reasonable expenses.

Article 14 (Changes to These Terms)

  1. The Organization may amend these Terms in accordance with the Civil Code and other applicable laws when required because of changes in laws, the Service, or other circumstances.
  2. When amending these Terms, the Organization will announce the changes and their effective date through the official website or another appropriate means by the effective date.
  3. If a User uses the Service after an amendment takes effect, the User is deemed to have agreed to the amended Terms. However, where individual consent is required by law, the Organization will obtain that consent separately.

Article 16 (Governing Law and Jurisdiction)

  1. These Terms are governed by the laws of Japan.
  2. The Saga District Court shall have exclusive jurisdiction in the first instance over disputes concerning the Service. This does not apply where another jurisdiction is permitted by law.
