These KuronekoServer SpeedTest Terms of Service (the “Terms”) set forth the conditions for using SpeedTest provided by the KuronekoServer operations team (the “Operations Team”) (the “Service”).
Any person who uses the Service (the “User”) must use it in accordance with these Terms.
Article 1 (Applicability)
- These Terms apply to all relationships between the User and the Operations Team relating to the use of the Service.
- In addition to these Terms, the Operations Team may establish separate rules, guidelines, or other terms of use (collectively, the “Individual Provisions”). Regardless of their name, such Individual Provisions constitute part of these Terms.

Article 2 (Prohibited Conduct)
In using the Service, the User must not engage in any of the following:

- Acts that intentionally use the Service in a manner intended to satisfy the requirements for disclosure requests under the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Sender Information (the “Provider Liability Limitation Act”), or acts that may lead to such use.
- Acts that exhaust resources due to unauthorized traffic (communications) from external or internal sources, thereby obstructing normal traffic of Users, etc.
- Acts that tamper with information used in IP network services, or acts that may do so.
- Unauthorized access to the Service, attempts thereof, or transmitting information that contains harmful computer programs.
- Violations of laws and regulations in Japan, or acts that encourage illegal conduct.
- Posting or sending information that is extremely offensive to others under common social norms, such as information about murder scenes, cruel content, images of animal abuse, etc.
- Acts that involve any interaction or involvement with anti-social forces (organized crime groups, members thereof, right-wing groups, anti-social forces, or similar; the same applies hereinafter), including cooperating with or participating in their maintenance, operation, or management.
- Reselling the Service without prior permission from the Organization.
- Illegal use or abuse of bugs, defects, vulnerabilities, etc. against the Organization.
- Acts that directly or indirectly cause, facilitate, or encourage any act falling under any of the preceding items, or acts that may do so.
- Posting links to sites that fall under, or may fall under, any of the preceding items.
- Violations of the terms of service and/or guidelines of service providers.
- Impersonating other Users, the Operations Team, or KuronekoServer.
- Acts that cause disadvantage or damage to the Service, the Operations Team, or Users.
- Connecting via Tor.
- Acts that defame or damage the reputation or credit of others.
- Uploading or publishing information containing sexual, violent, or discriminatory content.
- Collecting, using, or disclosing another person’s personal information without permission.
- Acts that impose excessive load on servers or networks, or acts that may do so.
- Usage methods that may cause registration with blacklist providers.
- Promoting one’s own website or content, or requesting others to do so, using methods generally considered spam (spam email, spam posts, spam trackbacks, etc.).
- Acts that significantly deviate from the intended use of the Service and hinder normal service operation.
- Any other acts deemed inappropriate by the Operations Team.
Article 3 (Restrictions)
If the Organization discovers a User who violates these Terms, the Organization will prohibit the provision of the Service to that User.
The Organization and the Operations Team shall not be liable for any disadvantage arising therefrom.
- If communications increase excessively, the Organization may restrict communications / block access.
Article 4 (Invalidation)
If it is discovered that any of the following applies, the Organization may suspend use and invalidate the right to use the Service, etc., without prior notice.
- When the Operations Team determines that the User has not read these Terms.

- When the Operations Team determines that the User has been forcibly terminated from other services provided by the Organization.

Article 5 (Preservation of Communication Logs)
In the following cases, the Organization shall not be obligated to dispose of log information that includes sender information, in order to protect the secrecy of communications.
- When a court, etc. issues an order to preserve logs (including an order prohibiting deletion of sender information) to the Organization.
- When a request to preserve logs is made to the Organization and the communication logs submitted by the requester match the information of the Organization’s facilities.
- When any other legally binding disposition is carried out pursuant to laws and regulations.
Article 6 (Commencement of Use and Usage Restrictions)
- These Terms apply when the User accesses the Service’s website.
- The Operations Team may restrict part or all of the Service in any of the following cases.
- When the User violates these Terms and/or Individual Provisions.
- When the User violates the terms of service and/or guidelines of service providers.
- Any other case where the Operations Team deems it inappropriate.
Article 7 (Termination or Suspension of the Service)
The Service may be terminated or temporarily suspended for any of the following reasons:
- When maintenance, inspection, or repairs of facilities required to provide the Service are performed.
- When server hardware maintenance work is performed.
- When program update work is performed.
- When server hardware or programs stop due to accidents, crashes, etc.
- When it becomes difficult to continue operating the Service due to unforeseen events such as earthquakes, lightning strikes, or heavy rain.
- Any other case where the Operations Team determines it is difficult to continue operating the Service.
Article 8 (Changes to the Service)
The Operations Team may change or discontinue the Service without notifying the User.
The Operations Team shall not be liable for any disadvantage or damage suffered by the User or any third party due to termination or suspension of the Service.

Article 13 (Governing Law and Jurisdiction)

- The Saga District Court shall have exclusive jurisdiction in the first instance over any disputes relating to the Service.
Article 14 (User Responsibility)
- If the User causes damage to a third party in connection with use of the Service, the User shall resolve such matters at the User’s own expense and responsibility.

Article 15 (Data Backups)
- The Service does not guarantee the storage of data.
- The User shall back up data at the User’s own responsibility.
