KuronekoServer Nyan Streaming Privacy Policy

KuronekoServer will strictly comply with the “KuronekoServer Nyan Streaming Privacy Policy” (the “Policy”).

Data Collected

  1. IP address
  2. Request details relating to access, streaming, and viewing
  3. Music usage reports submitted by Users through the control panel or another designated method
  4. Audio and music information processed for song recognition, including identifiers such as fingerprints
  5. Stream content (video and audio) temporarily recorded by the Operations Team only when necessary to identify music, verify usage, or investigate rights infringement
  6. If additional copyright royalties are charged, billing contact information, the amount charged, the payment deadline, payment status, and other information necessary to issue and collect the charge

Use of Data

  1. To provide and reliably operate the Service
  2. To perform analytics necessary to improve service quality
  3. To investigate and respond to attacks, unauthorized use, and violations of the Terms
  4. To identify music included in streams and verify usage
  5. To prepare and submit usage reports to NexTone, JASRAC, and other copyright management organizations
  6. To investigate and respond to infringements of copyright, neighboring rights, and other rights
  7. To calculate, bill, confirm payment of, and collect copyright royalties

Temporary Recordings for Administrative Purposes

The Operations Team may temporarily record stream content only when necessary to identify music, verify usage, or investigate rights infringement. These recordings are not made to provide an archive feature to Users and will not be made publicly available.

Usage may be verified by combining music reports submitted by Users, automated fingerprint recognition, and manual review by authorized staff. Access to recordings and music usage information is limited to Operations Team members who are authorized and require access for these duties.

Retention Period

Music usage reports, recognition results, and temporary recordings are retained only for the period reasonably necessary to prepare and submit quarterly usage reports to NexTone and JASRAC, each covering three months and broken down by month, and to complete any necessary reconciliation or investigation. Once the relevant purpose has been fulfilled, the data will be promptly deleted unless continued retention is required by law, for dispute handling, or for another legitimate reason.

Information relating to copyright-royalty charges and payments is retained for the period necessary to comply with law, perform accounting, collect charges, or handle disputes.

Deletion of Collected Information

If a User requests deletion of information, the Organization will verify the requester’s identity and respond promptly. However, information required for usage reporting, investigations of rights infringement or unauthorized use, legal obligations, or dispute handling may not be deleted during the period for which it is required.

Access Analytics

For access analytics, the Organization collects stream access counts and the number of streams.

Revisions to This Policy

The Operations Team may periodically revise the contents of this Policy.

SSL (Secure Socket Layer)

All services of the Organization support SSL and encrypt communications between viewers and streamers.

Optionally, it is possible to stream or view with SSL disabled. (HLS streaming/viewing is an exception.)

In addition, the streaming/viewing addresses of Node02 (global distribution) do not support SSL.

Provision to Third Parties

To submit usage reports under its license agreements, the Organization may provide NexTone, JASRAC, and other copyright management organizations with prescribed information such as work titles, lyricists and composers, artist names, month of use, and usage counts. Temporary recordings themselves are not included in ordinary usage reports. However, when necessary to respond to a rights-infringement investigation or to comply with law, the Organization may provide them to rights holders, copyright management organizations, or public authorities to the extent necessary.

Except in the cases above or as otherwise provided by laws, regulations, or guidelines, the Organization will not provide personal information to third parties without the User’s consent.
