These Terms set out the conditions for using Nyan Streaming Japan (the “Service”), provided by the KuronekoServer Operations Team (the “Operations Team” or “Organization”). Anyone using the Service (a “User”) must follow these Terms.

Article 1 (Applicability of the Terms)

  1. These Terms apply to all relationships between the User and the Operations Team concerning the use of the Service.
  2. The Operations Team may separately establish terms that set out usage conditions in addition to these Terms (the “Individual Provisions”). Regardless of their name, such Individual Provisions constitute part of these Terms.
  3. If there is any discrepancy between the Individual Provisions and these Terms, the Individual Provisions shall prevail unless otherwise specified.
  4. Copyright in all data and other content belongs to each respective author. If an author’s terms of use or other rules conflict with these Terms, the author’s terms shall prevail.
  5. Protect sign-in details, stream keys, viewing URLs and similar information from people who do not need them. If managing the Service with others, take care when adding or removing members. Users provide their own devices and connections and pay associated communication costs.

Article 2 (Prohibited Acts)

In using the Service, the User must not engage in any of the following acts:

  1. Acts that interfere with, or attempt to interfere with, the operation of the Service, KuronekoServer (the “Organization”), or services provided by third parties through the facilities of the Service.
  2. Acts that use the Service in a manner that may result in the global IP address used for IP communications being blacklisted, or that may otherwise worsen the Organization’s reputation or credit standing.
  3. Acts that place unnecessary load on the Organization’s facilities (network facilities, server facilities, etc.), whether intentionally or negligently, and thereby impair service quality or the ability of upstream providers to deliver their services.
  4. Infringing the rights of the Organization or third parties in a manner subject to legally authorized disclosure of sender information.
  5. Acts that exhaust resources due to unauthorized traffic (communications) from external or internal sources, thereby interfering with normal traffic of Users, etc.
  6. Acts that alter or tamper with information used in IP network services, or acts that may do so.
  7. Unauthorized access to the Service, attempts to do so, or transmitting information containing harmful computer programs.
  8. Acts that violate laws and regulations in Japan, or acts that encourage illegal conduct.
  9. Acts of posting, distributing, sharing, or sending to an unspecified large number of people information or content that may cause others extreme disgust under common social norms, such as information about murder scenes, cruel content, images of animal abuse, or content that is extremely offensive, obscene, lewd, or threatening and is intended to cause discomfort, intimidation, distress, or anxiety.
  10. Acts that involve any interaction or involvement with anti-social forces (gangs, gang members, right-wing groups, anti-social forces, or other similar entities; the same applies hereinafter), including cooperating with or participating in their maintenance, operation, or management.
  11. Reselling the Service without prior permission from the Organization.
  12. Illegal use or abuse of program bugs, defects, vulnerabilities, or similar issues against the Organization.
  13. Acts that directly or indirectly cause, facilitate, or encourage any act falling under any of the preceding items, or acts that may do so.
  14. Posting links to sites that fall under, or may fall under, any of the preceding items.
  15. Acts that violate the terms of service and/or guidelines of service providers.
  16. Impersonating other Users, the Operations Team, or KuronekoServer.
  17. Acts that cause disadvantage or damage to the Service, the Operations Team, or Users.
  18. In principle, the use of anonymization technologies such as Tor is prohibited. This is because anonymization makes abuse detection and response significantly more difficult. If you have unavoidable reasons, please contact the Operations Team in advance and obtain individual permission.
  19. Acts of streaming in violation of the copyright of any work.
  20. Reproducing, streaming, uploading, or providing works such as music, video, images, or text to third parties without permission from the copyright holder.
  21. Streaming or sharing illegally downloaded content or pirated content.
  22. Acts of providing information harmful to minors, or acts that violate online safety laws.
  23. Acts of streaming, sharing, or possessing content related to child sexual abuse, or any other content that violates the protection of minors.
  24. Streaming for 24 hours or longer on the Service.
  25. Using the Service for the purpose of streaming to platforms other than VR platforms (such as VRChat).
  26. Commercial use on the free plan, or use for profit-making purposes (excluding sponsorships and partners).
  27. Providing services using this streaming server (including continuous provision of commercial or non-commercial services using the server without prior consultation with and permission from the Operations Team).
  28. Any other act deemed inappropriate by the Operations Team.

If you wish to use the Service in a manner that falls under items (24) and (25) above, please contact the Operations Team in advance.

Operations response procedure: If the Operations Team confirms a violation of these Terms, it will generally respond in the following order. In urgent cases, immediate action may be taken exceptionally.

  1. Warning (notification by email, etc.)
  2. Temporary restriction (notification of the reason and period)
  3. Service suspension or account deletion (in cases of serious violations or failure to remedy)

The User may file an objection within 14 days after receiving notice. In principle, please contact abuse@krnk.org.

Article 3 (Copyright Compliance)

  1. The User must not engage in any act that infringes the copyright of a third party in connection with the Service.
  2. Content streamed or shared by the User must be limited to content for which the User has obtained the necessary copyright permissions.
  3. If a copyright infringement claim is made, the Operations Team may remove the relevant content or suspend use of the Service. When filing a copyright infringement claim (report), please provide as much of the following information as possible so that the matter can be handled promptly.
  • Name and contact information (email address)
  • A declaration that you are the copyright holder or an authorized representative (if you are a representative, materials showing your authority)
  • Identification of the copyrighted work alleged to be infringed (title, etc.)
  • Location information such as the URL or IP address where the content is hosted
  • Details of the reason for the claim and your understanding of false claims

Based on the information provided, the Operations Team will investigate and may take measures such as removal or restrictions as necessary. Procedures for counter-notice will be provided separately.

  1. If the User causes damage to a third party due to copyright infringement, the User shall bear all responsibility.
  2. If you stream music administered by NexTone or JASRAC through the Service, submit a music usage report through the dashboard before or after use. This report is generally not required for music not administered by these organizations.
  3. If the User fails to submit a report, or if the Operations Team determines that the report is insufficient, the Operations Team may impose usage restrictions or take other measures.
  4. Even if you are the songwriter, composer or performing artist, include the work in the report under paragraph 5 if its streaming rights have been entrusted to NexTone or JASRAC.
  5. The copyright management organizations covered by the Service are NexTone and JASRAC. Procedures for copyright in music and lyrics do not by themselves authorize rights in commercial recordings, karaoke recordings or performances. Contact the relevant record company, performer, artist management agency, music publisher or other rights holder in advance as needed and obtain the necessary permissions. Check the rights required to stream other works as well.
  6. The Operations Team may temporarily record stream content to the extent necessary to identify music, verify usage, and investigate rights infringement. These recordings are not made to provide an archive feature to Users.
  7. The Operations Team may verify usage through dashboard music reports and staff review and submit required reports to NexTone and JASRAC. Administrative recordings and related data are handled under the Service Privacy Policy.
  8. If use of music administered by NexTone or JASRAC substantially exceeds the level ordinarily anticipated for the Service and causes royalties to exceed the amount expressly covered by ordinary service fees or otherwise borne by the Operations Team, the User may be charged for all or part of the additional royalties resulting from the excess use. A charge may be made after use or after the management organization determines the royalties. Before charging, we notify the User of the usage period, usage records, calculation basis, amount and payment deadline. The User may submit an objection within 14 days after the date of notice.

Article 4 (Protection of Minors / Age Restrictions)

  1. The User must not stream or share sexual or obscene content (explicit nudity, sexual depictions, pornography, etc.) in a way that minors can view it. Please comply with Japan’s youth protection laws and the youth protection laws of each country or region where the servers are located.
  2. When streaming or sharing adult content, the following are mandatory.
  • If the destination platform supports age restrictions or mature content settings (e.g., NSFW), you must enable them and/or introduce age verification (for example, use an age-verified instance in VRChat).
  • If such features are not available, you must clearly indicate the age verification/restriction by other means.
  1. Creating, possessing, streaming, sharing, or linking any content related to child sexual abuse, child pornography, or any other conduct that amounts to the sexual exploitation or enticement of minors is strictly prohibited.

Article 5 (Compliance with Laws)

  1. Users must comply with Japanese law and mandatory laws applicable to their use and location.
  2. Destinations and supported protocols follow service notices. Server location alone does not determine all applicable laws.
  3. Necessary deletion or usage restrictions may be imposed to address infringement or unlawful conduct.

Article 6 (Restrictions)

We may restrict publishing, viewing or other use as necessary for violations, excessive load or reasonable security grounds. We normally notify reasons and corrective steps; urgent cases may require immediate action. Liability follows Article 13.

Article 7 (Invalidation)

If it is discovered that any of the following applies, the Organization may suspend use and invalidate the right to use the Service, etc. without prior notice.

  1. When the User commits a serious violation of these Terms and such violation is confirmed by a reasonable investigation.
  2. When the User attempts to affect the operation of the Service through unlawful acts.
  3. When the Operations Team determines that the User has been forcibly terminated or otherwise sanctioned on other services provided by the Organization.
  4. When the Operations Team determines that the User violates these Terms, etc.
  5. Any other case where the Operations Team determines that granting the right to use the Service, etc. is inappropriate.

Article 8 (Preservation of Communication Logs)

We may preserve necessary connection logs under law or a lawful preservation request. Preservation does not remove communications secrecy or other legal protections. Disclosure requires a lawful basis and is limited to what is necessary.

Article 9 (Commencement of Use and Usage Restrictions)

  1. These Terms apply when the User accesses the Service’s website or when the User streams or views content.
  2. The Operations Team may restrict part or all of the Service in any of the following cases.
  3. When the User violates these Terms and/or the Individual Provisions.
  4. When the User violates the terms of service and/or guidelines of service providers.
  5. Any other case where the Operations Team deems it inappropriate.

Article 10 (Reporting Contact)

  1. To report illegal content, copyright-infringing content, or other inappropriate content, please contact the following email address:

abuse@krnk.org

When reporting, please provide as much of the following information as possible:

  • Name and email address
  • Proof of ownership of the copyrighted material or authority to act on behalf of the owner
  • The specific website or IP address where the content is hosted
  • The reason for the notice
  1. To report security vulnerabilities, please refer to the following page and contact us:

    https://krnk.org/contact/vulnerability-reporting

  2. In principle, reports received at abuse@krnk.org will be reviewed and responded to within 24 hours.

For Service inquiries, contact support[at]krnk.org (replace [at] with @).

Article 11 (Termination or Suspension of the Service)

The Service may be terminated or temporarily suspended for any of the following reasons:

  1. When maintenance, inspection, or repairs of facilities required to provide the Service are performed.
  2. When server hardware maintenance work is performed.
  3. When program update work is performed.
  4. When server hardware or programs stop due to accidents, crashes, or similar events.
  5. When it becomes difficult to continue operating the Service due to unforeseen events such as earthquakes, lightning strikes, or heavy rain.
  6. Any other case where the Operations Team determines that it is difficult to continue operating the Service.

Article 12 (Changes to the Service)

Planned material changes or termination will be announced with reasonable advance notice. If emergency maintenance or security needs prevent advance notice, we will inform users afterwards where reasonably possible. Liability is governed by Article 13.

Article 13 (Disclaimer)

  1. We do not guarantee perfect availability, security, accuracy, fitness for a particular purpose or permanent data storage. Users should keep necessary originals and backups.
  2. Liability follows applicable law. We do not exclude or limit liability for intentional misconduct, gross negligence or liability that cannot legally be excluded.
  3. Parties handle disputes between users or with third parties; this does not exclude any statutory responsibility of the team.

Article 14 (Changes to These Terms)

  1. Amendments follow the Civil Code and other applicable laws. We announce the changes and effective date in advance.
  2. We obtain separate consent where legally required. Continued use alone does not establish consent to every amendment.

Article 15 (Handling of Data)

The Privacy Policy for this Service explains how we handle information. We use information needed for streaming and sign-in, recordings, usage and inquiries as necessary to provide the Service, protect security and comply with law. Disclosure to public authorities is limited to what is necessary on a lawful basis.

Article 16 (Governing Law and Jurisdiction)

  1. Japanese law governs these Terms.
  2. The Saga District Court is the agreed court of first instance, without restricting other jurisdiction allowed by law or mandatory consumer rights.

Article 17 (Features and costs)

The Service does not provide user recording, file uploads or paid-plan purchasing and billing. Contracts or storage allowances from other services do not carry over. Operator recordings for music verification or infringement investigations may be made under Article 3. The absence of ordinary billing does not waive additional royalties under Article 3, paragraph 13.
