These KuronekoServer Nyan Streaming Terms of Service (the “Terms”) set forth the conditions of use for all Nyan Streaming services (the “Service”) provided by the KuronekoServer Operations Team (the “Operations Team”).
Any person who uses the Service (the “User”) must use the Service in accordance with these Terms.
Article 1 (Applicability of the Terms)
- These Terms apply to all relationships between the User and the Operations Team concerning the use of the Service.
- The Operations Team may separately establish terms that set out usage conditions in addition to these Terms (the “Individual Provisions”). Regardless of their name, such Individual Provisions constitute part of these Terms.
- If there is any discrepancy between the Individual Provisions and these Terms, the Individual Provisions shall prevail unless otherwise specified.
- Copyright in all data and other content belongs to each respective author. If an author’s terms of use or other rules conflict with these Terms, the author’s terms shall prevail.
Article 2 (Prohibited Acts)
In using the Service, the User must not engage in any of the following acts:
- Acts that interfere with, or attempt to interfere with, the operation of the Service, KuronekoServer (the “Organization”), or services provided by third parties through the facilities of the Service.
- Acts that use the Service in a manner that may result in the global IP address used for IP communications being blacklisted, or that may otherwise worsen the Organization’s reputation or credit standing.
- Acts that place unnecessary load on the Organization’s facilities (network facilities, server facilities, etc.), whether intentionally or negligently, and thereby impair service quality or the ability of upstream providers to deliver their services.
- Acts that intentionally use the Service in a manner that satisfies the requirements for a disclosure request under the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Sender Information (the “Provider Liability Limitation Act”), or acts that may lead to such use.
- Acts that exhaust resources due to unauthorized traffic (communications) from external or internal sources, thereby interfering with normal traffic of Users, etc.
- Acts that alter or tamper with information used in IP network services, or acts that may do so.
- Unauthorized access to the Service, attempts to do so, or transmitting information containing harmful computer programs.
- Acts that violate laws and regulations in Japan, or acts that encourage illegal conduct.
- Acts of posting or sending information that may cause others extreme disgust under common social norms, such as information about murder scenes, cruel content, images of animal abuse, or other similar content.
- Acts that involve any interaction or involvement with anti-social forces (gangs, gang members, right-wing groups, anti-social forces, or other similar entities; the same applies hereinafter), including cooperating with or participating in their maintenance, operation, or management.
- Reselling the Service without prior permission from the Organization.
- Illegal use or abuse of program bugs, defects, vulnerabilities, or similar issues against the Organization.
- Acts that directly or indirectly cause, facilitate, or encourage any act falling under any of the preceding items, or acts that may do so.
- Posting links to sites that fall under, or may fall under, any of the preceding items.
- Acts that violate the terms of service and/or guidelines of service providers.
- Impersonating other Users, the Operations Team, or KuronekoServer.
- Acts that cause disadvantage or damage to the Service, the Operations Team, or Users.
- In principle, the use of anonymization technologies such as Tor is prohibited. This is because anonymization makes abuse detection and response significantly more difficult. If you have unavoidable reasons, please contact the Operations Team in advance and obtain individual permission.
- Acts of streaming in violation of the copyright of any work.
- Reproducing, streaming, uploading, or providing works such as music, video, images, or text to third parties without permission from the copyright holder.
- Streaming or sharing illegally downloaded content or pirated content.
- Acts of providing information harmful to minors, or acts that violate online safety laws.
- Acts of streaming, sharing, or possessing content related to child sexual abuse, or any other content that violates the protection of minors.
- Acts of streaming on this server for 24 hours or more (except Node04).
- Using the Service for the purpose of streaming to platforms other than VR platforms (such as VRChat or Resonite).
- Commercial use on the free plan, or use for profit-making purposes (excluding sponsorships and partners).
- Providing services using this streaming server (including continuous provision of commercial or non-commercial services using the server without prior consultation with and permission from the Operations Team).
- Any other act deemed inappropriate by the Operations Team.
If you wish to use the Service in a manner that falls under items (24) and (25) above, please contact the Operations Team in advance.
Operations response procedure: If the Operations Team confirms a violation of these Terms, it will generally respond in the following order. In urgent cases, immediate action may be taken exceptionally.
- Warning (notification by email, etc.)
- Temporary restriction (notification of the reason and period)
- Service suspension or account deletion (in cases of serious violations or failure to remedy)

Article 3 (Copyright Compliance)
- The User must not engage in any act that infringes the copyright of a third party in connection with the Service.
- Content streamed or shared by the User must be limited to content for which the User has obtained the necessary copyright permissions.
- If a copyright infringement claim is made, the Operations Team may remove the relevant content or suspend use of the Service. When filing a copyright infringement claim (report), please provide as much of the following information as possible so that the matter can be handled promptly.
- Name and contact information (email address)
- A declaration that you are the copyright holder or an authorized representative (if you are a representative, materials showing your authority)
- Identification of the copyrighted work alleged to be infringed (title, etc.)
- Location information such as the URL or IP address where the content is hosted
- Details of the reason for the claim and your understanding of false claims
Based on the information provided, the Operations Team will investigate and may take measures such as removal or restrictions as necessary. Procedures for counter-notice will be provided separately.
- If the User causes damage to a third party due to copyright infringement, the User shall bear all responsibility.
- When streaming works managed by NexTone/JASRAC on Node01 (Japan-only streaming server), the User must report them in advance using the method designated by the Operations Team. Reports can be submitted through the reporting feature in the control panel. As a general rule, this report is not required for works that are not managed by NexTone/JASRAC.
- If the User fails to submit a report, or if the Operations Team determines that the report is insufficient, the Operations Team may impose usage restrictions or take other measures.
- If streaming that includes copyrighted works is confirmed on servers other than Node01, the Operations Team may impose usage restrictions or take other measures.
- Only works for which the User has obtained the necessary permission from the copyright holder may be used for streaming. If the User uses works managed by JASRAC/NexTone, only works permitted for internet streaming may be used, and the User must confirm the permission status and complete any required procedures at their own responsibility.
- When streaming music on servers other than Node01, such as Node02, works managed by NexTone/JASRAC may not be used.
Article 4 (Protection of Minors / Age Restrictions)
- The User must not stream or share sexual or obscene content (explicit nudity, sexual depictions, pornography, etc.) in a way that minors can view it. Please comply with Japan’s youth protection laws and the youth protection laws of each country or region where the servers are located.
- When streaming or sharing adult content, the following are mandatory.
- If the destination platform supports age restrictions or mature content settings (e.g., NSFW), you must enable them and/or introduce age verification (for example, use an age-verified instance in VRChat).
- If such features are not available, you must clearly indicate the age restriction within the video.
- Creating, possessing, streaming, sharing, or linking any content related to child sexual abuse, child pornography, or any other conduct that amounts to the sexual exploitation or enticement of minors is strictly prohibited.
Article 5 (Regional Applicability / Compliance with Laws)
- Japan-only servers (servers installed in Japan) are subject only to Japanese law.
- Servers that share streams worldwide are located in Canada, the United States, India, the United Kingdom, France, Singapore, Japan, and Hong Kong. For streaming and viewing using these servers, the laws of the country or region where the server is located and Japanese law apply together.
- If the above laws conflict, the stricter standard shall take precedence from the perspectives of protecting minors, copyright and intellectual property rights, and ensuring safety.
- For legal compliance and operational judgment, content removal, account restrictions, and similar measures may be implemented.
- The Service uses the laws of the country where the server is located and Japanese law as its enforcement standards. Users must also confirm and comply with the laws of their own place of residence or viewing at their own responsibility.
Article 6 (Restrictions)
If the Organization discovers a User who violates these Terms, the Organization will prohibit the provision of the Service to that User.
The Organization and the Operations Team shall not be liable for any disadvantage arising therefrom.
- If communications increase excessively, the Organization may restrict communications or block access.
Article 7 (Invalidation)
If it is discovered that any of the following applies, the Organization may suspend use and invalidate the right to use the Service, etc. without prior notice.
- When the User commits a serious violation of these Terms and such violation is confirmed by a reasonable investigation.
- When the User attempts to affect the operation of the Service through unlawful acts.
- When the Operations Team determines that the User has been forcibly terminated or otherwise sanctioned on other services provided by the Organization.
- When the Operations Team determines that the User violates these Terms, etc.
- Any other case where the Operations Team determines that granting the right to use the Service, etc. is inappropriate.
Article 8 (Preservation of Communication Logs)
In the following cases, the Organization shall not be obligated to dispose of log information that includes sender information, in order to protect the secrecy of communications.
- When a court, etc. issues an order to preserve logs (including an order prohibiting deletion of sender information) to the Organization.
- When a request to preserve logs is made to the Organization and the communication logs submitted by the requester match the information in the Organization’s facilities.
- When any other legally binding disposition is carried out pursuant to laws and regulations.
Article 9 (Commencement of Use and Usage Restrictions)
- These Terms apply when the User accesses the Service’s website or when the User streams or views content.
- The Operations Team may restrict part or all of the Service in any of the following cases.
- When the User violates these Terms and/or the Individual Provisions.
- When the User violates the terms of service and/or guidelines of service providers.
- Any other case where the Operations Team deems it inappropriate.
Article 10 (Reporting Contact)

- In principle, reports received at abuse@krnk.org will be reviewed and responded to within 24 hours. This applies to all services provided by KuronekoServer.
Article 11 (Termination or Suspension of the Service)
The Service may be terminated or temporarily suspended for any of the following reasons:
- When maintenance, inspection, or repairs of facilities required to provide the Service are performed.
- When server hardware maintenance work is performed.
- When program update work is performed.
- When server hardware or programs stop due to accidents, crashes, or similar events.
- When it becomes difficult to continue operating the Service due to unforeseen events such as earthquakes, lightning strikes, or heavy rain.
- Any other case where the Operations Team determines that it is difficult to continue operating the Service.
Article 12 (Changes to the Service)
The Operations Team may change or discontinue the Service without notifying the User.
The Operations Team shall not be liable for any disadvantage or damage suffered by the User or any third party due to termination or suspension of the Service.
Article 13 (Disclaimer)
- The Operations Team does not expressly or impliedly warrant that the Service is free from factual or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, suitability for a particular purpose, security, errors, bugs, or infringement of rights).
- The Operations Team shall not be liable for any disadvantage suffered by the User arising from the Service.
- The Operations Team shall not be responsible for any disputes or transactions arising between Users or between a User and a third party in connection with the Service.
Article 14 (Changes to These Terms)
- The Operations Team may change these Terms and the Individual Provisions without prior notice to the User.
- If the User continues to use the Service after receiving notice from the Operations Team about a change to the Terms, the User shall be deemed to have agreed to the revised Terms.
Article 15 (Handling of Data)
The Operations Team shall manage data obtained in connection with use of the Service in accordance with the “KuronekoServer Nyan Streaming Privacy Policy”.
However, this does not apply when compulsory measures based on Article 218 of the Code of Criminal Procedure (search by warrant) are carried out, or when the requirements for disclosure requests under the Provider Liability Limitation Act are satisfied.
Article 16 (Governing Law and Jurisdiction)
- These Terms shall be governed by the laws of Japan.
- The Saga District Court shall have exclusive jurisdiction in the first instance over any disputes relating to the Service.
