These NyanCast Terms of Service (the “Terms”) set forth the conditions for using the desktop application “NyanCast” and its connection signaling service (collectively, the “Service”) provided by KuronekoServer (the “Organization”).

Introduction: Important points to know

The following summarizes the Terms. Please refer to each article for the formal conditions.

  • The Service connects one VJ and up to eight DJs to share screens, cameras, and audio selected by DJs with the VJ in real time.
  • Shared media is transmitted directly between DJ and VJ devices using WebRTC. The Organization’s signaling servers do not relay, record, or store shared media. However, they cannot prevent recipients from recording it using other functions or equipment.
  • Because connections are P2P, public IP addresses, ports, and other network information may be disclosed to the connected peer and to Cloudflare and Google STUN services.
  • When sharing third-party screens, voices, video, personal information, music, or other copyrighted works, users must verify the necessary rights and consent themselves.
  • Room IDs are not confidential information. An optional room password provides supplementary access control and does not guarantee identity verification or complete prevention of unauthorized participation.
  • The Service is currently provided without account registration or usage fees. Communication quality, continued availability, and successful connections in particular environments are not guaranteed.

Article 1 (Scope)

  1. These Terms apply between the Organization and everyone who creates a room, shares screens, cameras, or audio through the Service, receives such content, or otherwise uses the Service (“Users”).
  2. Notices, guidelines, and other conditions established by the Organization on its official website, within the application, on distribution pages, in documentation, or by other means (“Individual Provisions”) form part of these Terms.
  3. If these Terms conflict with Individual Provisions, the Individual Provisions take precedence unless they specify otherwise.

Article 2 (Acceptance of the Terms and Minors)

  1. Users must agree to these Terms and the NyanCast Privacy Policy before using the Service.
  2. Users are deemed to have agreed to these Terms when they begin using the Service, create a room, or join a room.
  3. Minors must obtain the consent of their legal representative and complete any other procedures required by law before using the Service.

Article 3 (Service Description)

  1. The Service enables DJs to join a room created by a VJ and share their selected screen, application window, camera, microphone audio, or computer output audio with the VJ in real time.
  2. A room can accommodate one VJ and up to eight DJs. Media sharing and voice calls between DJs are not provided.
  3. Capture begins when a DJ selects a sharing source and starts sharing. When sharing is paused or the DJ leaves the room, the application stops acquiring input.
  4. Shared media is transmitted directly between DJ and VJ devices over encrypted WebRTC connections. The Organization does not relay, record video or audio, or archive shared media on its servers.
  5. To establish connections, the Service forwards connection information, such as SDP and ICE candidates, between the VJ and the relevant DJ through a signaling service on Cloudflare.
  6. The Service does not provide a public room directory or user identity verification. Display names do not guarantee a person’s real name or identity.
  7. Supported environments, features, participant limits, and other conditions of provision are as stated on the official website, distribution pages, in documentation, or within the application.

Article 4 (Required Environment and Costs)

  1. Users are responsible, at their own expense, for preparing the devices, supported operating systems, cameras, microphones, network connections, and other environments needed to use the Service.
  2. Users bear communication charges, equipment costs, and other expenses charged by telecommunications providers or other third parties.
  3. The Service is currently provided without account registration or usage fees. If paid features are offered in the future, their fees and other conditions will be displayed separately before use.
  4. For security and compatibility, Users must endeavor to use new versions provided by the Organization and supported operating systems and WebView runtimes.

Article 5 (Room Management and Access Information)

  1. VJs must set a room ID they can manage and, where necessary, a room password.
  2. Share room IDs, room passwords, and invitation information only with people permitted to participate. Users must take care to prevent disclosure through forwarding to third parties, unintended appearance on screen, or other means.
  3. Room IDs are not designed as confidential information and are used to check room status. Anyone who knows the ID of a room without a password can attempt to join it.
  4. Room passwords do not verify identity. The Organization does not guarantee that someone connecting with the correct room ID and password is the participant intended by the VJ.
  5. Do not use passwords reused on other services, easily guessed passwords, or passwords containing personal information.
  6. The handling of room passwords is described in the NyanCast Privacy Policy.

Article 6 (Shared Content and Responsibilities between Users)

  1. Users who share content must verify for themselves that they hold all copyrights, neighboring rights, portrait rights, privacy rights, and other rights or permissions necessary to transmit it.
  2. Users must check whether shared content may include third-party images, voices, notifications, messages, authentication information, personal information, trade secrets, or other nonpublic information, and obtain necessary consent, conceal such information, and limit the scope of sharing.
  3. Recipients must not record video or audio, reproduce, publicly transmit, redistribute, publish, or provide shared content to third parties without permission from the sharer and relevant rights holders.
  4. When using received content outside the Service, including for event projection, streaming, or recording, Users must obtain the permissions necessary for that use from the sharer and relevant rights holders.
  5. When sharing or using music, commercial sound recordings, video, game screens, or other copyrighted works, Users must check the conditions specified by copyright holders, copyright management organizations, record labels, performers, platforms, and other rights holders and complete the procedures required for their intended use.
  6. Rights in shared content remain with the User or legitimate rights holder. Use of the Service does not transfer ownership of shared content or usage rights beyond the scope of this article to the Organization or other Users.
  7. The Organization is not a party to shared content, sharing purposes, rights clearance, agreements, or disputes between Users.

Article 7 (Prohibited Conduct)

Users must not engage in the following conduct when using the Service.

  1. Violating laws, public order and morals, these Terms, or Individual Provisions.
  2. Infringing the copyrights, neighboring rights, trademark rights, portrait rights, privacy rights, reputation, creditworthiness, trade secrets, or other rights or interests of the Organization or third parties.
  3. Acquiring, sharing, recording, publishing, or using another person’s private video, audio, conversations, personal information, or confidential information without that person’s consent.
  4. Sharing child sexual abuse material, child pornography, sexual exploitation, nonconsensual sexual images, or other illegal or harmful content.
  5. Fraud, threats, harassment, discrimination, impersonation, stalking, or other conduct causing disadvantage or harm to third parties.
  6. Unauthorized access, transmission of malware, exploitation of vulnerabilities, password brute-force attacks, interference with communications, or other conduct harming the Service or third-party facilities or information.
  7. Circumventing participant limits, message size limits, connection permissions, other technical restrictions, or access controls.
  8. Placing unnecessary load on the Service or third-party facilities through automated connections, mass room creation, excessive communications, or similar conduct.
  9. Using another person’s room ID, password, token, device, or display name without authorization.
  10. Misusing information obtained through defects, vulnerabilities, or misconfigurations in the Service, or disclosing it to third parties beyond the necessary scope.
  11. Making false or misleading representations about relationships with the Organization or third parties.
  12. Conduct similar to the foregoing or other conduct that the Organization reasonably considers inappropriate for providing the Service or protecting its users.

Article 8 (Usage Restrictions and Safety)

  1. If a User violates these Terms, the Organization reasonably determines that a violation is likely, or measures are necessary to protect the Service and its users, the Organization may, without prior notice, refuse connections, close rooms, restrict communications, suspend use from specific connection sources, or take other necessary measures.
  2. The Organization may preserve or provide information to the extent necessary to comply with lawful requests under applicable law or from courts, investigative authorities, or other competent authorities, or to respond to legitimate reports from rights holders.
  3. The Organization is not liable for damage to Users resulting from the measures in the preceding two paragraphs unless the cause is attributable to the Organization.

Article 9 (Communications and Privacy)

  1. The Organization processes connection information and communication metadata to the extent necessary to provide the Service, facilitate connections, ensure safety, respond to incidents, prevent abuse, and comply with laws.
  2. WebRTC communications are encrypted in transit, but shared content can be viewed or played on the device of a legitimately connected VJ. Encryption does not prevent the connected peer from recording, filming, or reusing content.
  3. Because the Service uses direct P2P connections, public IP addresses, ports, and other network information may be disclosed to the connected peer. The Service cannot be used as an anonymization service.
  4. The handling of information in the Service is described in the NyanCast Privacy Policy.

Article 10 (External Services)

  1. The Service uses services or runtimes provided by Cloudflare, Google, Microsoft, and other third parties for signaling, assistance with P2P connections, application operation, and other purposes.
  2. External services may be subject to their providers’ terms of use and privacy policies.
  3. The Organization cannot control interruptions, failures, specification changes, usage restrictions, or information handling by external services and is not liable for them unless the cause is attributable to the Organization.

Article 11 (Intellectual Property and Software Use)

  1. Rights in the software, names, logos, websites, documentation, and other content relating to the Service belong to the Organization or legitimate rights holders.
  2. The Organization grants Users a nonexclusive, nontransferable right to use the applications it distributes only to the extent necessary to use the Service in accordance with these Terms.
  3. Except where permitted by law or applicable open-source licenses, Users must not reproduce, modify, sell, redistribute, reverse engineer, decompile, or disassemble the Service’s software or content without the Organization’s permission.
  4. Third-party software included in the Service is subject to its respective license terms. Major software components and their licenses can be viewed in the application’s “Credits” section.

Article 12 (Changes, Suspension, and Termination of the Service)

  1. The Organization may change, suspend, or terminate all or part of the Service due to maintenance, failures, security needs, changes to equipment or external services, usage conditions, legal requirements, or other circumstances.
  2. Planned outages or significant changes will be announced in advance on the official website or by other appropriate means to the extent reasonably practicable, except in emergencies.
  3. For this Service provided free of charge, the Organization does not guarantee the duration of provision, continuity, availability, or future provision.

Article 13 (Disclaimer of Warranties and Limitation of Liability)

  1. The Organization does not guarantee constant availability, absence of failures, successful P2P connections, communications without delays or disconnections, sharing quality, safety, completeness, accuracy, fitness for a particular purpose, or compatibility with particular equipment or software.
  2. Users must understand the risks of unintended screen or audio sharing, incorrect sharing source selection, device notifications, volume, delays, disconnections, recording by recipients, and other risks, and check their sharing status themselves when using the Service.
  3. If Users suffer damage attributable to the Organization and the Organization is liable under law, its liability is limited to actual, direct, and ordinary damage. This limitation does not apply in cases of the Organization’s intent or gross negligence, or where liability cannot be limited by law.
  4. Except where liable under law, the Organization is not liable for lost profits, lost business opportunities, loss of data, recording or publication by third parties, indirect damage, special damage, or damage that would not ordinarily arise, whether foreseeable or not.

Article 14 (Disputes with Third Parties)

  1. If a dispute arises between Users or between a User and a third party regarding shared content, rights, consent, recording, streaming, or other matters relating to the Service, the Users who are parties to the dispute must resolve it at their own responsibility and expense.
  2. If the Organization incurs damage or expenses attributable to a User, that User must bear the damage and reasonable expenses.

Article 15 (Changes to These Terms)

  1. When necessary due to changes in laws, the Service, or other circumstances, the Organization may amend these Terms in accordance with the Civil Code of Japan and other applicable laws.
  2. When amending these Terms, the Organization will announce the changes and their effective date on the official website, within the application, or by other appropriate means no later than the effective date.
  3. Users who use the Service after the amendments are deemed to have agreed to the amended Terms. However, separate consent will be obtained where individual user consent is required by law.

Article 16 (Inquiries and Reports)

Article 17 (Governing Law and Jurisdiction)

  1. These Terms are interpreted and applied in accordance with Japanese law.
  2. The Saga District Court has exclusive agreed jurisdiction as the court of first instance over disputes relating to the Service, except where another jurisdiction is permitted by law.
