These KuronekoServer Games Terms of Service (the “Terms”) set out the conditions for using the paid game server rental service “KuronekoServer Games” (the “Service”) provided by the KuronekoServer operations team (the “Team”).

Article 1 (Scope and Formation of the Contract)

  1. These Terms apply between the user contracting for the Service (the “User”) and the Team. Players and additional administrators invited by the User are referred to below as “Players and Administrators”.
  2. Users must review these Terms and the plan conditions displayed when applying. A contract is formed when the Team accepts the application. Individually agreed conditions take precedence where they differ from these Terms.
  3. Users must provide accurate registration information and update it when it changes. Minors must obtain consent from a parent or other legal representative and complete any other procedures required by law.
  4. The Team may decline applications for reasonable reasons, including false information, serious past violations or insufficient capacity. If an application is declined without providing the Service, any service fees already received will be refunded.

Article 2 (Service Details)

  1. The Service provides a game server runtime environment and supported management functions according to the contracted plan. See the plan description for supported games, resources, indicative player capacity, backup features and support coverage.
  2. Game purchases, paid mods, plugins and other third-party charges are not included in service fees unless expressly stated otherwise.
  3. Performance varies with game specifications, concurrent players, world size, installed software, shared infrastructure load and network conditions. Unless separately guaranteed, the Team does not guarantee a particular processing speed, latency, uptime or satisfactory performance for a particular number of players.

Article 3 (Fees and Renewal)

  1. Fees, contract periods, payment methods, payment dates, automatic renewal and additional charges are displayed on the application screen. Unless otherwise stated, fees are prepaid. The initial service period starts when the server is made available and the User is notified.
  2. Plans with automatic renewal renew for the displayed contract period unless cancellation is completed by the stated deadline. The next renewal date and amount can be checked through the management interface or another method specified by the Team.
  3. Stopping a game server, having no players or not signing in does not automatically end the contract or billing. Any additional or usage-based charges require prior disclosure of their scope, rates and calculation method and the User’s agreement.
  4. Fee changes will be notified before taking effect, with a reasonable period to choose whether to renew or cancel. Changed fees will not apply retroactively to a prepaid contract period.

Article 4 (Cancellation and Refunds)

  1. Users may request cancellation through the management interface or another specified method. The deadline and reference time for stopping the next renewal are displayed when applying and in the contract management information.
  2. Cancellation for the User’s convenience generally takes effect at the end of the prepaid contract period, and the Service remains available until then. No prorated refund is provided for that period in such cases.
  3. If the Team cannot provide the Service for reasons attributable to its operations and ends all or part of the contract, prepaid fees corresponding to the unprovided portion will be refunded. Duplicate or incorrect charges will also be refunded after verification.
  4. This Article does not restrict statutory rights to rescind or terminate a contract, receive a refund or claim damages.

Article 5 (Account and Server Management)

  1. Users must protect login information and grant additional administrators only the access they need. Suspected unauthorized use or disclosure must be reported to the Team promptly.
  2. Users must manage their server’s visibility, participation conditions, in-game rules and access granted to Players and Administrators, and take reasonably available action when they discover harassment or misuse.
  3. Users collecting or using information about Players and Administrators must comply with applicable law, including explaining the information collected, its purposes and a contact point. Disputes involving Users and Players and Administrators should generally be handled by the parties concerned. This does not affect the Team’s statutory responsibilities.

Article 6 (Games and Installed Software)

  1. Users must obtain the necessary rights to use games, mods, plugins and other software and comply with the rights holders’ conditions. Monetization, including donations and paid benefits, must also comply with those conditions and applicable law.
  2. Software installation, configuration changes and updates must stay within the supported functions. Unless expressly included in support coverage, Users are responsible for investigating and resolving problems caused by software they install.

Article 7 (Prohibited Conduct)

Users must not use the Service for the following conduct. They must also inform Players and Administrators of the rules needed to use the Service safely.

  1. Illegal conduct, fraud, threats, harassment, discrimination, impersonation or unauthorized disclosure of personal information.
  2. Infringing copyright, trademarks, privacy or other rights of others.
  3. Using or distributing pirated software, violating licenses or using the Service to circumvent legitimate authentication unlawfully.
  4. Unauthorized access, malware distribution, DoS or DDoS attacks, exploitation of vulnerabilities or other attacks.
  5. Using or distributing cheats or unauthorized tools in violation of the rules of a game or a server being accessed.
  6. Circumventing resource limits or disrupting other users or infrastructure through excessive traffic or heavy processing.
  7. Using resources for unsupported purposes, such as cryptocurrency mining or operating solely as a file distribution service.
  8. Reselling or subletting the management environment without prior permission. Ordinary invitations for players to join the User’s game server are excluded.
  9. Providing benefits to antisocial forces, or conduct comparable to the above that specifically harms the safe provision of the Service or others’ rights.

Article 8 (Traffic and Usage Restrictions)

  1. The Team measures traffic volume, bandwidth usage, connection counts and resource usage to maintain stable service and protect infrastructure. Any plan-specific limits, including traffic allowances, are displayed when applying.
  2. If traffic increases excessively, large amounts of bandwidth are used continuously, contracted limits are exceeded, or the Team reasonably determines that other users or upstream infrastructure may be affected, the Team may impose necessary restrictions, including speed controls, connection limits, blocking particular traffic or temporarily stopping the game server.
  3. The Team generally explains the reason, restriction and improvement measures in advance. For emergencies such as DDoS attacks, sudden load increases or serious security risks, it may act without prior notice and provide information afterward where possible. Restrictions will be lifted when no longer necessary.
  4. For violations or nonpayment, the Team generally notifies the User of the reason and a deadline to remedy the issue. Unresolved issues may result in suspension or contract termination. Immediate action may be taken for serious illegal conduct or urgent safety needs.
  5. Users may ask the support contact for an explanation or reconsideration of restrictions. Restrictions under this Article do not themselves authorize additional charges that were not agreed in advance. The Team’s responsibility for restrictions is governed by Article 11.

Article 9 (Stored Data and Backups)

  1. Rights in worlds, saves, configuration files and other data remain with the User or the lawful rights holder. The Team handles this data only as necessary to provide, maintain, back up or restore the Service.
  2. Where backup features are provided, their scope, frequency, retention periods and restoration methods are specified in the service information. They do not guarantee data from every point in time or complete recovery. Users should also keep important data outside the Service.
  3. After the contract ends, server data is deleted after the retention period notified in advance. Users must obtain necessary data before their use ends. Backups are deleted according to the stated retention periods and backup rotation.
  4. Reviewing the contents of stored data or logs is limited to legally permitted purposes and the minimum necessary scope, such as requested support, fault or misuse investigations, or legal compliance. The Team respects the confidentiality of communications and other statutory protections.

Article 10 (Maintenance, Changes and Discontinuation)

  1. Maintenance, game or software updates, faults, attacks or disasters may require restarts, server migration or temporary interruption. Planned work is generally announced in advance; emergency work is explained afterward where possible.
  2. Planned changes to major features or discontinuation of the Service will be announced with a reasonable notice period reflecting their impact, including the changes, effective date, data retrieval methods and necessary procedures. Any legally required consent will be obtained separately.
  3. Prepaid fees for periods not provided due to discontinuation or similar circumstances will be settled and refunded according to Article 4.

Article 11 (Warranties and Responsibility)

  1. The Team does not guarantee uninterrupted availability, freedom from faults, suitability for a particular purpose or permanent data storage. It endeavors to provide stable service and restore service after faults.
  2. Where the Team has a legal responsibility, it will act in accordance with applicable law. These Terms do not exclude or limit liability for intentional misconduct, gross negligence or any other liability that cannot legally be excluded or limited.
  3. Users are responsible to the extent that their attributable conduct causes harm to others. Where third-party software, network failures or attacks are involved, responsibility will be determined under applicable law based on the cause and the Team’s response.

Article 12 (Changes to the Terms)

Changes to these Terms will follow the Civil Code and other applicable laws. The changes and effective date will be announced in advance on the official website or by other appropriate means. Individual consent will be obtained separately where required by law.

Article 13 (Handling of Information)

The information handled about Users and Players and Administrators, its purposes, retention, outsourcing, third-party disclosure and requests for access or deletion are described in the KuronekoServer Games Privacy Policy.

Article 14 (Contact, Governing Law and Jurisdiction)

For contracts and support, contact support@krnk.org. Report misuse or rights infringements to abuse@krnk.org. For vulnerabilities, see the dedicated contact. The address and person responsible for operations are listed in the operator information.

These Terms are governed by Japanese law. The Saga District Court is the agreed court of first instance for disputes relating to the Service. This does not restrict other jurisdiction available under law or consumers’ rights.
